Using the Service

The Service provides daily motivational quotes, journaling tools, community features, and related content. You may use the Service for personal, non-commercial purposes in accordance with these Terms.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Submit content that is abusive, hateful, threatening, obscene, defamatory, or that infringes on the rights of others.
• Attempt to interfere with the operation of the Service, including through automated scripts, bots, or other unauthorized access methods.
• Impersonate another person or misrepresent your affiliation with any person or entity.
• Reverse-engineer, decompile, or disassemble any part of the Service.
• Use the Service to distribute spam, malware, or other harmful material.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms.

Subscriptions and Purchases

The Service offers optional premium features available through paid subscription plans, including monthly, annual, and lifetime options. Subscriptions are billed through the app store where you made your purchase (the “App Store”).

Billing and renewal

Monthly and annual subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the applicable subscription price at the beginning of each renewal period. Prices are displayed in the app and may vary by region and currency.

Free trials

If a free trial is offered, you will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will begin and you will be charged the applicable price.

Cancellation

You may cancel your subscription at any time through your App Store account settings. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that period ends. We do not offer refunds for partial billing periods.

Restore purchases

If you reinstall the app or switch devices, you can restore your active subscription through the restore purchases option in the app.

Pricing and taxes

Subscription prices are set by us and are subject to change. We will notify you of any price changes before they take effect. All prices may be subject to applicable taxes, which are determined by the App Store and your jurisdiction.

Refunds

Refund requests are handled by the App Store in accordance with their refund policies. Please contact the App Store directly for refund inquiries.

User-Generated Content

The Service allows you to submit quotes and optional author attributions through the community feature (“User Content”). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, and transferable license to use, display, reproduce, modify, translate, distribute, and create derivative works of your User Content in connection with the Service.

You represent that you have the right to submit any User Content you provide, and that it does not violate the rights of any third party.

We reserve the right to review, moderate, filter, translate, edit, approve, or reject any User Content at our sole discretion, for any reason. We are not obligated to publish, display, or maintain any User Content. Approved community quotes may be visible to all users of the Service.

You may not submit User Content that contains personal information about others without their consent, or that is misleading about its source or authorship.

Intellectual Property

The Service, including its design, code, content, branding, original quote selections, and visual assets, is owned by 365 Positive Days and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works based on the Service or its content, except as expressly permitted by these Terms or by applicable law.

User Content you submit remains yours, subject to the license you grant us above.

Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any content will be accurate or complete. Motivational quotes and content provided through the Service are for personal inspiration only and do not constitute professional advice of any kind — including medical, psychological, legal, or financial advice.

Limitation of Liability

To the maximum extent permitted by applicable law, 365 Positive Days and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claim arising from or related to the Service will not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

Termination

We may suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms. Upon termination, your right to use the Service ends immediately. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and governing law.

Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the “Last updated” date at the top. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree with the changes, you should stop using the Service.

Governing Law

These Terms are governed by and construed in accordance with the laws of Mexico, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts in Mexico.
